"Imagine that the United States is intercepting al Qaeda communications in Yemen. Its leader there calls his weapons expert and says, “Our agent in the U.S... "

This argument is the one used by the Bush Administration, and does not apply here because the surveillance is of all domestic US communications using a participating provider, regardless of whether one end of that communication is in a foreign nation or right here in the US. In other words, even purely domestic comms are being monitored by the NSA, with no probable cause whatsoever.
