then ipso facto it was not "effective"

therefore this law claims that breaking in is only illegal if you don't do it

Less flippantly, remember that the EFF is made up of the kind of people who believe that copyright is a meaningless artifact of pretechnological times and that it's only big-business protectionism that keeps it going today. The would be entirely OK with the idea that you can't hold someone guilty for taking stuff that was "just lying around" (or "improperly secured", as they'd put it.)
